Although a written tenancy agreement is not legally required it is recommended that you have a written document setting out the terms of the agreement between you and your tenant.

Each tenancy agreement will be different as it should be specific to the type and length of the tenancy and also on whether you are letting an entire property or the accomodation is shared. Garages and parking spaces can be included in a tenancy agreement or it may be desirable to put a separate letting agreement in place as you may wish to end one tenancy before the other. An inventory is a very useful document to keep track of what was provided at the start of the tenancy and the condition of your items. It can be used at the end of the tenancy to check everything is in place before repaying the deposit. The inventory must be signed by the tenant so you are both in agreement. A Notice to Quit can be used by the landlord to request that a tenant moves out of the property by a particular date if a tenancy period has not been set. The landlord can issue a Notice Requiring Possession to request that the tenant moves out of the property in cases Where an Assured Shorthold Tenancy agreement is in place. The landlord can subsequently issue a Section 21 Notice on or after the deadline date to end a fixed term tenancy. This is a Possession Notice served on the tenant with a minimum notice period of two months. A Section 8 notice can be issued by the landlord to end the tenancy during the fixed term if the tenant has breached the terms of the fixed tenancy agreement. This is provided for by the Housing Act 1988. An example of a breach could be that the tenant has failed to pay the rent or damaged the property. The Section 8 notice informs the tenant that you intend to repossess your property and outlines your reasons for doing so. It is an essential step in the procedure for eviction. You can only apply to the Court to issue an Order of Possession if you have already issued a Section 8 Notice. If your tenant wishes to move out before the end of the tenancy period but would like to pass the property on to a replacement (friend, relative, colleague etc) a Deed of Assignment is required. The Landlord needs to give consent before any new tenant can take over. A clause could be included in the initial tenancy agreement stating whether or not a Deed of Assignment would be permitted.
